This Terms of Service Agreement is entered into between the Artist and the Client for the commission of an artwork. By commissioning the Artist, @Natomiie, the Client agrees to the following terms:

General
ㅤCOMMISSION ACCEPTANCEㅤ I reserve the right to decline commissions without specifying reasons, though I generally will as a courtesy.
ㅤARTWORK MODIFICATIONSㅤ Clients are strictly prohibited from modifying the artwork without permission. I reserve the right to deny permissions at my own discretion.
ㅤARTIST CREDITㅤ Clients are required to provide artist credit to @Natomiie wherever the artwork is displayed. Claiming the work as one's own or someone else’s is prohibited.
ㅤWATERMARK & SIGNATUREㅤ All commissions will feature a digital watermark or signature, except for VTuber models and emotes/badges. Removing or editing the watermark is strictly forbidden. Requests for a version without the signature can be made in advance, with an explanation. Even without a watermark, artist credit is mandatory for public displays.
ㅤBLOCKCHAIN & AI USAGEㅤ Use of any artwork by Natomiie in distributed ledgers, blockchain, NFTs, cryptocurrency, or AI art training is STRICTLY PROHIBITED.
ㅤOPTIONAL CONFIDENTIALITYㅤ Clients requesting non-disclosure of progress or final artwork in website, portfolios, and social media must pay a confidentiality fee starting at $100+ USD, subject to variation based on the commission's complexity.
intellectual property rights
ㅤARTWORK OWNERSHIPㅤ I retain full copyright and ownership of the artwork, granting clients exclusive rights for personal use only. Art may be used for personal/decorative, non-commercial purposes, excluding streaming/content use.
ㅤ@NATOMIIE COPYRIGHTSㅤ All copyrights for artworks created under the artist name @Natomiie are held by @Natomiie.
ㅤCOMMERCIAL USE RESTRICTIONSㅤ Clients are prohibited from using any artwork for commercial purposes, including reproduction for merchandise or resale to third parties, without my approval & payment for commercial rights.
ㅤCOMMERCIAL RIGHTS & LICENSING FEEㅤ Contact me to discuss licensing fees to gain commercial rights, which vary based on the artwork and purpose. Licensing fee start at 200% over the base price. Emotes and badges can obtain commercial rights for a one-time fee of $50 per artwork.
ㅤARTWORK DISPLAYㅤ I reserve the right to showcase and display commissioned artwork on my website, portfolios, and social media for self-promotion. Notify me in advance if you prefer non-public display, and I'll accommodate as best as possible; such as waiting to post until client posts, partial previews, or other reasonable compromises.
Payment
ㅤPAYMENT METHODSㅤ All payments must be made in USD through VGen, Ko-Fi, or Paypal Invoicing.
ㅤPAYMENT SCHEDULEㅤ Commissions must be paid within 7 days of approving the sketch design & color scheme. Failure to pay will result in a pause, and no progress will be made until payment is received. Continuous progress may be considered for trusted clients.
ㅤCOMMUNICATION ON PAYMENTㅤ If you don't have the payment ready during the sketching period, please inform me in advance. I'm willing to wait if there's open communication about your financial situation.
ㅤPAYMENT DEADLINE & CANCELLATIONㅤ Unpaid orders after 1 month, without communication regarding financial situation or commission interest, will result in instant cancellation. At this point, there will be no follow-up confirmation; no new requests accepted.
deadlines & Delivery
ㅤOPTIONAL DEADLINESㅤ Deadlines are optional when placing an order. All services have a general "turnaround time" (TAT). If you desire a specific completion date, please inform me.
ㅤCOMMUNICATION ON TURNAROUND TIMESㅤ Any changes impacting the turnaround time will be communicated. As a part-time freelancer, life situations may impact my availability. Delays will be communicated through direct messages or Twitter announcements.
ㅤEXPEDITED DELIVERY FEESㅤ Expedited delivery incurs an additional 30%+ fee for completion sooner than the listed turnaround time. Rush fees vary based on proximity to the desired deadline.
ㅤDIGITAL DELIVERYㅤ Final products are delivered via a Google Drive link in a dedicated folder. Download your final product(s) promptly, as the folder may not be kept on my drive long-term.

ㅤSUBMIT REQUEST FORMㅤ Commission me by submitting a Request Form on VGen!
ㅤCONFIRMATION & DISCUSSIONㅤ Upon reviewing your form, I'll confirm if I can take your commission. We'll discuss details, including total price, commission specifics, and start date.
ㅤFIRST-COME, FIRST-SERVEㅤ Commissions operate on a first-come, first-served basis. Order may shift based on timely responses, completion time, expedited orders, or quick completion.
ㅤSKETCH APPROVALㅤ Approve the sketch design and color scheme. Unlimited revisions are allowed during this phase (details under "Revisions").
ㅤPAYMENT & PROCESSINGㅤ After sketch approval, payment must be made within 7 days via VGen/Ko-Fi/PayPal Invoicing. Failure to pay within 7 days results in a pause. Payment confirmation will continue the commission.
ㅤUPDATES & REVISIONSㅤ Check Trello or reach out once a day for updates. Major revisions incur additional fees (details under "Revisions"). Minor revisions are OK!

ㅤUNLIMITED SKETCH REVISIONSㅤ Clients have unlimited revisions during the sketch period. If dissatisfied after revisions, clients are welcome to reconsider working with me. Use this period to ensure satisfaction with your commission!
ㅤMAJOR REVISION FEESㅤ Major revisions, after sketch approval, will incur an additional 50% of the total cost. This fee applies when clients wish to change the approved concept design, color scheme, pose/composition, and so on.
Minor revisions are OKAY!!
Fee may be waived if artist error was made regarding missing details on original specifications.
REfund policy
ㅤFULL REFUND SCENARIOSㅤ Clients are eligible for 100% refunds in three situations:
(1) Inability to complete the commission after payment.
(2) Client pays ahead of time but wishes to cancel before sketch approval.
(3) No updates after 1 month past deadline or estimated turnaround time.
ㅤNO 100% REFUNDS AFTER SKETCH APPROVALㅤ I cannot offer full refunds once the artwork is completed or after sketch approval.
ㅤUNLIMITED REVISIONS DURING SKETCH PERIODㅤ In order to avoid refunds, clients can request unlimited revisions during the sketch period. If unsatisfied, clients are welcome to reconsider working with me. Use this period to ensure satisfaction with your commission!
